The MVTA's terms and conditions listed below apply to all academy clients and must be accepted prior to the start of the first tennis lesson.
CANCELLATION POLICY
– Scheduled lessons must be cancelled 24 hours prior to the start of the hour. Failure to cancel will result in being charged the full cost of the lesson, which includes the price of the reserved court.
– Cancellations must be made in writing via e-mail or by communicating directly and always in writing to the coach.
– Fixed private lessons, are automatically placed at the same time each week. In case of absence due to vacation, or for any other reason, a written notice must be forwarded communicating the date of return and resumption of classes.
– The same rules apply to group classes as for individual classes. Clients who cancel the lesson after 24 hours from the start will be charged the corresponding amount. In the case of only a single participant remaining in the group, they may choose to play a private lesson, or permanently cancel the lesson for the given date and time, again within 24 hours of the start.
– If a client or group cancels the fixed lesson too consistently, MVTA reserves the right to permanently cancel the lesson and resell it to another client.
– Semi-flexible conditions on the court reservation are applied to all players and groups playing during peak hours from Monday to Friday between 17-21 hrs, on Wednesdays from 14-17 hrs and all weekends as follows: if the players of the group or a private lesson cancel before 24 hours, the MVTA will try to sell the court to another interested customer. If no interested customer can be found, the court will be offered for sale online to all persons. If the court cannot be sold online, the cost of the court will be invoiced and divided by the number of players participating in the given lesson.
– Children and junior group classes, must be paid in advance and for the entire season. At 2 weeks before the start of the course, it is not possible to receive any refund and to cancel the subscription. Refund is also not applied in case of absence. In case of prolonged illness or injury, starting from 4 weeks of absence and with medical justification, MVTA will compensate for the missed hours with private lessons that will be arranged later or by placing the player in an alternative group if one of the players in the same group is missing. More flexible conditions apply to adult groups.
WEATHER CONDITIONS
– In case of sudden bad weather before the scheduled lesson, the lesson will be cancelled without charge or will be relocated upon availability to an indoor facility. Prices may change.
– The following conditions are applied: from the first minute to the 15th minute of play, the lesson is cancelled without further charge; from the 15th minute to the 45th minute of play, the 50% charge is applied from the full price; after the 45th minute of play until the end of the hour, the full charge is applied.
PRICES
– All prices are in Swiss Francs.
– Prices may vary by hour of play, by tennis club, and by season.
– The MVTA reserves the right to change the price of lessons at any time and a written notice will be sent to clients.
PAYMENTS
– Lesson and course payments will be made by bank transfer.
– The invoice for lessons will be sent by the end of the following month for the previous month (e.g. the invoice for March will be sent in April).
– The invoice must be paid within 10 days of receipt. In the event of non-payment, the MVTA will issue an initial reminder and a surcharge of CHF 10 will be applied to the amount. The original amount plus the 10 CHF surcharge shall be paid within 10 days after receipt of the reminder. Should the deadline of the first reminder not be met, the MVTA shall issue a second reminder. In this case, the amount shall be increased by 50% of the amount due (including the CHF 10 of the first reminder) with a further 10 days for payment. In the event that the deadline for this last reminder is also not met, the applicable Swiss law on the non-performance of an obligation shall apply and the competent authorities shall be called in.
– For new customers or customers not resident in Switzerland, the MVTA shall be entitled to receive payment in cash immediately after the lesson. The invoice will be sent within the next few days by e-mail.
PROGRAMS AND TEST TRAINING
– Programs are subject to change.
– Training programs for children, juniors and adults are decribed at www.mv-ta.com
– Programs can be discussed and changed between MVTA and clients.
– Test training is used to determine the level of play, as well as the future group in which the client may be placed.
– Test training is billed as a private lesson.
– In some cases there may not be an adequate training group or it may be full. In that case MVTA will propose alternative solutions.
WORKING HOURS AND PLAYING TIME
– The academy’s working hours are from 9 a.m., until 9 p.m. at night.
– For extra-hour courses, please contact MVTA directly.
– The playing time is 55 minutes. The 5 minutes before the end of class is for picking up balls and setting up the playing field for the next hour.
BEHAVIOR AND REMOVAL FROM CLASS
– The MVTA demands proper behavior on the court toward the coach and other people.
– Players who fail to comply with the above conditions will be eliminated from practice and the class will be fully billed.
INTENSIVE TRAINING WEEKS AND COURSES DURING VACATIONS
– MVTA also offers classes during vacation periods for all clients.
– Children’s and junior courses will be conducted only if there is an adequate number of participants.
– Special training packages will be offered to clients.
– Children’s and juniors’ fixed classes will be cancelled, but can be resumed on request even during vacations.
– Adult fixed private lessons and also adult groups will continue during the vacations and will be cancelled only with the notice of the participants.
SPORTS EQUIPMENT SALE
– The sale of sports equipment and offered to clients.
– Recommendations for purchase are free of charge.
– Defects in materials are non-refundable, but MVTA will make every effort to discuss with suppliers for an aduguate solution, but without warranty.
EQUIPMENT, FACILITY AND PLAYING FIELDS
– Playing equipment is provided by the MVTA.
– Equipment is defined as practice balls, cones, moving lines, ball baskets and the necessities on the tennis court. Racquets can be rented at a rate of 10chf per hour.
– Equipment, use of the facility and courts are included in the price of the lesson. Different conditions apply for extra uses of the facility such as sauna and gym.
RACQUET STRINGING
– The stringing service is offered to academy and non-academy clients and includes racquet pickup and delivery in the price. Delivery takes place at the pickup location.
– Price may vary depending on cost of strings and delivery time.
– Damaged racquets are not picked up except having discussed with the customer prior to the stringing service.
– Early string breakage is not subject to refund or re-stringing of the racquet.
– The service is provided by a professional tuner with high quality materials and machinery.
SUPERVISION OF MINORS UNDER 18 YEARS OF AGE
– Supervision of minors is strictly limited to practice time. The MVTA disclaims any responsibility outside of practice hours.
– Parents or guardians must make arrangements to bring and pick up minors before and after class. In case of changes, parents or responsible persons must notify the coach of the instructions to be followed by the minors. Minors in the absence of those in charge, must abide by the communications and rules of the coaches.
ACCIDENTS AND INSURANCE
– MVTA disclaims any liability in case of accident of participants before, during or after classes.
– Medical insurance must be in the possession of participants in case of accidents and injuries.
– In case of damage to third parties, MVTA is covered by the insurance, which, however, disclaims liability in case of disrespect, misuse of matrials, tennis courts or the tennis club facility.
– In case of theft, the MVTA disclaims all liability.
PHYSICAL AND HEALTH CONDITIONS
– Course participants must be aware that they are adequately healthy and fit to participate in the sports lessons offered.
– MVTA disclaims all responsibility for physical and mental health conditions.
– Participants must have medical insurance to participate in the courses.
VOUCHERS
– Gift vouchers are available for all customers.
– Vouchers must be paid for in advance before the start of lessons.
– The validity of vouchers is seasonal. They must be used by the end of the summer or winter season and cannot be transferred from one person to another.
– The voucher will lose its value if not used by the end of the season.
DISPUTES
– In case of disputes between MVTA and clients, Swiss Law applies.
